Staff Present: Drew McManus (Conservation Agent) and Kris Carpenter (Administrative Secretary)
The meeting was called to order with a quorum by Vice Chairman Shaw at 6:55 pm.
There was no public comment.
Pre/Post Hearing Agenda
1) Approval of Minutes from 3/18/10
Motion made, seconded and unanimously carried to approve the minutes of March 18, 2010.
2) Administrative Approval: SE 43-2579 (21 Bowsprit Road) – Alter & Realign Boardwalk, Parking Area and Low Boulder Wall.
Applicable Resource Area: Buffer Zone to Coastal Bank
Anne Lucius from Keith LeBlanc Landscape Architecture represented the homeowner and is requesting three revisions to the original plan of record. The first change is to realign the boardwalk to create a more direct route which will result in less square footage of coverage. The second revision will be to realign the edge of the parking area to accommodate the transition of the boardwalk. The last revision is to remove and reset some of the brick paving on the southeast side of the house due to the slight grading and they will place a low 12-18” boulder wall so as not to cover existing tree roots with fill.
Agent McManus states that all changes are within the pre-approved work limit.

3) Updates:
- MACC E-Newsletter – Agent McManus would like to check to make sure everyone has been receiving the newsletters via email and mentions some training that was in the latest publication which he would recommend signing up for.
- Garney Farley Site Visit – The date for the site visit has not been finalized as of yet because of pending return of Chairman Fitzsimmons. Brad Sweet suggests looking at the Quashnet River Bogs as well since everyone will be together.
**Additional notes**
* All three Herring Runs (Santuit Pond, Mashpee/Wakeby and Johns Pond) are all active with Herring.
* There were calls received from residents regarding Mashpee/Wakeby Pond and the high water levels. Agent McManus explains that DPW went in with a front loader (as has been done historically) at the outlet of Mashpee/Wakeby where the river starts and removed sand that has built up on both sides. The Agent removed some of the boards from Santuit Pond and Johns Pond.
- Dumping Updates (camera trial?) – Agent McManus discovered another pile near Johns Pond with a bag full of bank financial statements which contains contact information. A citation has been sent to the responsible party. This will make four separate dumpings in two weeks.
- Form 2: Attach to all Administrative Approvals – A checklist has been created which is available on line, to assist applicants with the process and what needs to be included when submitting paperwork. Form 2, Status of Board of Appeals Jurisdiction, will now be included on the checklist because of a recent filing that involved an applicant that wanted to re-locate a pool that was previously permitted. Conservation had approved the Administrative Approval but because a pool is considered a structure, any revisions also need to be approved with the Building Department.

7:00 Jamie Shone NOI SE 43-2600 (49 Tide Run) – Demo / Rebuild Fire Damaged Home
Applicable Resource Area: ACEC Flood Zone & Buffer Zone to Coastal Bank
Attorney Kevin Kirrane represented the homeowner and mentions the concerns from the Board at the last meeting of the location of the dwelling and the pool/patio and since then have revised the plans to pull the pool back and align it with the existing foundation of the house.
Steve Wilson from Baxter Nye also explains that the pool feature and patio have been pulled back and they do still have the two work limits one having a chain link fence to prevent construction equipment near the existing bank and damaging any trees. The second limit is at the top of the bank for the landscape work
Dan Solein from Solein Landscape talks about the plantings which have been revised and the buffer expanded due to the increased setback of the structure. There is about 1200 sq. ft of native plants within the buffer which is 1100 sq. ft. more than the existing plantings. The project is a significant improvement of the present conditions and will also consist of three new trees that will replace the three trees that were previously removed off of the bank. The situation will be much richer for wild life and much more stable because of all the new plantings. Mr. Solein believes that the pool will be the focus of activity and lessen the impact of foot and play traffic through the resource area. Mr. Sweet questions the levels
as the street seems to be the “high” point and dips in the front yard, rises to the house and rises again to the bank so he is concerned of the drainage. Mr. Solein states that with the construction of the house, the front yard will be leveled and there will no longer be a dip in the front. Mr. Wilson shows four leach pits to pick up all the hard surface drainage and recharged into the ground. A perk test will be completed within one week.
Agent McManus believes that the improvements are right in line as to where they were left off at the previous meetings. The planting plan is a tremendous upgrade to existing conditions. Mr. McManus mentions a letter received from an abutter that he will read in summary for the record. Mr. McManus recommends a close and issue.

7:03 Jamie Weinstein AOC SE 43-2135 (387 Monomoscoy Road) Modify Landscaped Areas, Extend Stone Driveway and Pier Continued to 4/29/10 @ 7:06pm
Applicable Resource Area: Land Subject to Coastal Storm Flow/Buffer Zone to Salt Marsh.

7:06 Paul Gardner RDA (8 Sakonnet Drive) Remove Two Trees & Prune Others
Applicable Resource Area: Inland Bank leading to Johns Pond
Tim Pinzino from Bartlett Tree is representing the homeowner stated that a large Hickory has been removed because it was leaning towards the house and had become a hazard to the dwelling which Agent McManus confirms that it was an immediate hazard. Mr. Pinzino also would like to do some pruning on the side of the house to lessen any potential damage the house along with a tree on the other side where the top had snapped off. There is a large oak in the front that overhangs the house and walkway that could damage vehicles in the driveway with fallen branches.

7:09 Jenny Kouloris RDA (18 Starboard Lane) Remove Tree, Repair Stone Wall and Mitigation

Matthew Foley from Casey Landscape is representing the homeowner. He explains the pitch pine in the rear of the property along a stone wall and the roots of the tree are damaging the wall. They would like to remove the tree and plant six shrubs along with repairing the stone wall. Agent McManus states that it is straight forward with very minimal disturbance to any resource area.

7:12 John’s Pond North Cove Association RDA (4 Shorewood Drive) Remove Tree
Applicable Resource Area: John’s Pond
Bill Holmes, President of John’s Pond North Cove Association explains the existence of a pitch pine that has shown evidence of bark beetle damage and they would like to remove the tree to preserve the health of two existing oak trees next to it. Agent McManus says that the tree does have pine borer damage. The Agent also mentions that it is apparent that someone has “topped” the oak trees and it is noted that the trees should not be cut as the beach is the property of the Commonwealth nor was any request made to the local concom for the topping of the two oak trees. Mr. Sweet recommends having a couple of the other pines in the vicinity examined for illness as well and Agent McManus states that he will take a look at
them. Mr. Allen would like to suggest replacing the pine with another tree, possibly another oak tree.

7:15 Mashpee Health Care NOI (161 Falmouth Road) Replace Failing Septic System with 6000 Gallon Pump Chamber/Pump Station
Applicable Resource Area: Buffer to Inland Bank (armored) and Buffer to BVW
Lori McDonald from Baxter Nye Engineering is representing Mashpee Health Care and explains that they would like to replace an existing failed Title V septic system with a new sewer pump station and forced main which will connect 161 Falmouth Road through 133 Falmouth Road up Noisy Hole Road to a new treatment facility located at Cotuit Meadows. Silt fencing will be installed adjacent to the wetland resource areas and trees and shrubs will be cleared within the silt fence area. A new 6000 gallon pump facility will be installed in the back of 161 Falmouth Road and will connect into the existing 18000 gallon septic tank to the pump chamber which will pump to the forced main. The line itself is 4” PVC. Once everything is
installed, the existing facility will be taken off line and the leaching fields will be pumped dry and abandoned. The trenches will be backfilled and the area will be re-vegetated with loam and seed. The silt fencing will stay until the seed has taken hold. There may be some possible clearance near the leaching fields to allow it to be pumped/drained. The pipe will be laid next to the asphalt except in one small location at 133 where approximately 20’ of pavement will need to be cut. Mr. Cross and Mr. Allen recommended that Schedule 80 pipe be used instead of 40 because of durability.
